TERMS & CONDITIONS OF SALE

These terms apply to products and services supplied by Sinterra Surfaces Pty Ltd (ABN 16 689 064 462). By placing an order, accepting a quote or making payment, you agree to these terms.

Quotes, orders and payment

Prices are in Australian dollars and include GST only where stated. Freight, fabrication, installation and other services are excluded unless expressly included in writing. A quote is valid for the period stated in the quote. An order becomes binding when accepted by Sinterra Surfaces. Payment is required in accordance with the quote, invoice or checkout terms.

Product information and natural variation

Stone and surface products may vary in colour, tone, pattern, texture, veining, thickness and finish. Photographs, displays and samples are indicative only and may not represent the full variation of a slab, sheet or finished installation. Customers must check suitability, measurements, quantities and product details before ordering.

Availability and lead times

Availability and lead times are estimates and may change due to stock, suppliers, transport or circumstances beyond our reasonable control. We will notify you of material changes where practicable.

Collection, delivery and risk

Slabs and sheets are supplied for collection from our nominated Sydney warehouse unless freight is separately agreed in writing. Collection must be booked and confirmed. The customer or its carrier must provide suitable transport, equipment and personnel. Risk passes when the goods are collected by or delivered to the customer or its nominated carrier, subject to applicable law.

Fabrication and installation

Unless expressly agreed in writing, fabrication, installation, site preparation, sealing and related services are not supplied by Sinterra Surfaces. Customers must use suitably qualified professionals and follow applicable product, care and installation instructions. Sinterra Surfaces is not responsible for damage caused by incorrect handling, storage, fabrication, installation, maintenance or use, except where liability cannot lawfully be excluded.

Inspection and claims

Please inspect goods promptly on collection or delivery. Notify us as soon as possible of any damage, shortage or apparent issue and retain the goods, packaging, photographs and order details for assessment.

Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.

Liability

To the extent permitted by law, Sinterra Surfaces is not liable for indirect or consequential loss. Where a statutory guarantee applies and limitation is permitted, our liability is limited to the remedies available under applicable law.

General

If any provision is unenforceable, the remaining provisions continue to apply. These terms are governed by the laws of New South Wales, Australia.
